1. Who We Are

PingTact is a SaaS platform for business messaging via Meta's WhatsApp Business API, operated by [Legal Entity], CR [CR Number], address [National Address], contact: info@pingtact.com.

2. Data We Collect

• Account data: name, email, mobile, company, password (encrypted).
• Your customers' contacts: numbers and names uploaded by the subscriber to send messages.
• Message & conversation content and delivery/read status.
• Technical usage data: login logs, IP, and essential cookies.

3. Purposes of Processing

Operating your account, sending/receiving WhatsApp messages on your behalf, reports, support, subscription management, and protecting the platform — based on contract performance, legitimate interest, legal compliance and your consent where required.

4. Roles

The subscriber is the controller of its customers' data; PingTact acts as a processor under its instructions. The subscriber is responsible for obtaining recipients' consents.

5. Data Sharing

We do not sell your data. We may share it with Meta (to deliver messages), hosting/email/payment providers, and competent authorities upon a lawful request.

6. Cross-Border Transfer

Some data may be processed outside the Kingdom via Meta's infrastructure, in line with the PDPL and with appropriate safeguards.

7. Retention & Security

We retain data for the subscription term and as legally required, applying encryption, access control and per-subscriber data isolation.

8. Your Rights

You have the rights to be informed, access, correct, erase, and withdraw consent. Contact info@pingtact.com; you may also complain to SDAIA.

9. WhatsApp Messaging & Opt-Out

Recipient consent is required; recipients may stop messages by sending "stop" or "unsubscribe".

1. Acceptance & Eligibility

By using the platform you agree to these terms and the Privacy Policy; you must be authorised and 18 or older.

2. Service Description

The platform provides business-messaging tools via the WhatsApp Business API (campaigns, conversations, chatbot, reports). It is a technical intermediary and does not own the WhatsApp service provided by Meta.

3. Subscriptions & Fees

Plans with user/message limits, paid in advance with manual renewal. Fees for prior periods are non-refundable except as required by law or agreed in writing.

4. Acceptable Use

• No spam or messaging recipients without consent.
• No unlawful content or infringement of others' rights.
• No fraud, hacking, or unauthorised access.
• Compliance with Meta and WhatsApp policies.

5. Your Responsibilities

Obtain recipients' consent and honour opt-out requests. Any restriction Meta imposes on your number is outside the platform's responsibility.

6. Ownership

Your data and content remain yours; you grant us a limited licence to process them to run the service. The platform and its software remain ours.

7. Disclaimer & Liability

The service is provided "as is". To the extent permitted by law we are not liable for indirect damages, and our liability shall not exceed fees paid in the last three months.

8. Termination & Law

We may suspend accounts upon breach. These terms are governed by the laws of Saudi Arabia and its courts have jurisdiction over disputes.
